Well, well, they received a favorable ruling from the IRS on the Indian Coal Tax Credit, now they just need approval by "The Investor", seems like that should be just a formality. (Just who is this "Investor" with a capital "I" anyway?)

It would appear the two main stumbling blocks for 2009 would appear to be pension funding and bonding requirements. I think funding the pension deficit with WLB common stock is a win-win, hope that works out. (The company going BK doesn't do retirees any good at all).

Maybe "The Investor" can help out with bonding requirements? (I assume the bonding requirements relate to the Absaloka Mine anyway). I was also thinking about having the Crow Tribe help out, but have no idea of their financial abilities. (But I also have no idea of what the actual dollar figure is. Hope this is covered in the CC).

Seglem trial date is May 18th, 2009. (The company could be on the hook for $1.6m if Seglem wins).

What will Tontine do with all their shares? I hope they hold on to them. I think if WLB can make it thru 2009 without having to incur any more debt, they are out of the woods. That's my story, I'm sticking with it. If none of this makes any sense, I will blame my current case of insomnia. Which I blame on daylight savings time, I haven't slept good all week.
