At the beginning of the year, there were approx. 32 employees laid off at the Portland plant in Michigan. Recall rights last up to six months at this plant. Three employees were recalled, but only two were recalled by seniority (meaning they were the top two employees laid off to be recalled first.) The third was "in the middle of the pack." According to the business manager, he was recalled due to his ability to run multiple operations. However, due to being laid off for more than three months, no one was "qualified" to run any job in any cell due to the stature of being out of work for more than 90 days and exhausting their qualified period. Every laid off employee would have to be re-qualified in each position.

Is a company policy a legally binding document, or is it more so a good will offering to show that they have guidelines that the company should follow but they can do whatever they want?
