The impact of the proposed legislation on PMU is less clear. Generally legislation is not retroactive and ES may appear to be trying to avoid it's signed treaty obligations if it bases it's dealings with PMU with the new legislation in mind.
While I can understand the concern of nations wanting to protect themselves from frivolous suits, I would think ES would want to resolve the PMU issue based on the laws and trade agreements in place at the time PMU made it's investments in ES.
Anything less than that would appear dictatorial I think... don't you?
