The MOSH case was beautiful example of robbing the cookie jar while everyone was looking the other way. The diversion was perfect. While everyone looked at PXD,JPM,The Trustee, and the Plaintiffs in their arguments to stop attorneys fees, I just had to laugh. The whole time their(the unit holders) attention was being diverted by this false conspiracy they had the power to get what they wanted all by themselves without ever asking the judge. The key to this is the trust indenture, it ALWAYS was. The trust indenture is a binding contract that lays out exactly how the trust is to be run and what powers the trustee may hold and exercise. It is the indenture the judge had to reference when the plaintiffs and defendants asked for their fees. It was the indenture the judge had to reference to allow the trustee to dissolve the trust. It was the indenture that needed to be changed all along, and the unit holders had the power to do it too. It is the indenture that gives the trustee the power to decide all these things. The whole process for changing it was laid out in the indenture. If only they hadn't foolishly wasted their time and money trying to guard the cardboard hen house set up most likely by the plaintiff.

The trust indenture has never been changed or challenged over the entire course of the trial. It LEGALLY spells out that attorneys fees are allowed to defend the trust, the trustee, and yes even certain unit holder actions. The judges hands were tied by that document the whole time, but no one bothered to follow the rope.

I was not going to let it slip before the end it would have ruined my case study in these type of scams. I did offer to sell my services lte in the game but there were no takers. All you had to do was pull together enough unit holders and vote. It's the law, you had the power, but no one bothered to read the rules. It was never about the defendants at all. But Im sure someone is sure glad you thought it was.
