Lee, I agree. I think it all comes down to what the appellate court says on appeal if it goes there.

I also wonder what the SDNY Court says about the Aurelius suit. The bank group, 3rd avenue and aurelius suits are all the same in terms of what they are alleging, just the nature of the injury done to each is different.
I read this just as showing that there will be no resolution of National in the near term, at least.
