At June 30, 2009, the Company’s total risk based capital decreased to 12.8%. Although the Consolidated/Holding Company's capital ratio is slightly below the ratio committed to regulators, as of June 30, 2009 and December 31, 2008, CIT Bank was well capitalized under the regulatory framework of prompt corrective action.
