RIM settled with NTP because the judge was about to enforce an injunction silencing all Blackberries.

In fact, the patent office was just about to issue its second final rejection on NTP's patents -- meaning that it was almost to point where the patents were ruled invalid. But that development just came about too late to be relevant to the district court proceedings on the injunction.

This was a fluke that even the lawyers hadn't expected. Since NTP's patents were so obviously going to be invalidated, RIM didn't think a judge would actually take it off line. Expensive miscall. NTP (a patent troll) would have settled for $10 mm at the beginning.

The real point is that having patents may not mean much for GETG. The value is as a branded consumer product. The company would probably benefit if there were more bio-oils, since that would validate the whole sector.
