...it's not the time you actually become aware of the damage, it's the time that you COULD have become aware of the damage once you knew you might have actually been "damaged". Otherwise, the court may rule tat any delay in your becoming aware of damages after the fact is simply your lack of timeliness in discovery.

The clock starts ticking the moment the damages actually occur and information to disclose it becomes available. Whether a damaged individual actually gets that information or not is irrelevant with respect to the clock the court uses.

Bottom line, the clock starts ticking the moment the information became available, regardless of whether or not you've taken the initiative to get that information.
