Damn, I just wrote a whole long response to you SURG and Yahoo wiped it out! Here's a condensed version:

1)The important patents do not run out until 2018, not 2013. The 2018 patent is a combo patent for Levulan with BLUE light. That should give DUSA protection until 2018 no matter what happens with the patent office decision.

2)Galderma/GSK bought METVIXIA for the OTHER upcoming products, not just for the AK indication, which is inferior to Levulan/PDT for AKs.
They also get an upcoming ACNE indication, which unlike DUSA's failed acne trial, IS working. And they get future indications for skin cancers and other cancers. THAT is really why they did the deal.

3)We all know that the next 5 years for DUSA are very mainly dependent on domestic Levualn/PDT AK indication. Management has made many bad decisions, at least for shareholders, in the past; but the decision to concentrate on the medical/hospital segement for AKs was and is a good one.

4)If the domestic Levualn/PDT growth rate continues at 20%+ for the next few years, then DUSA's stock should be a huge winner, from where it is now.

5)In my mind, one of the only unknowns is what will happen with our healthcare system????
What will happen with the reimbursement rates for the Levualn/PDT treatment of AKs???
That rate has been getting very nice increases the past few years.
Under a new healthcare system, those increases might be much smaller or non-existent. But, there might be more patients covered who seek treatment. It's an unknown.
On balance, I think DUSA will be ok in this regard.

6)Remember that last year FDA past a new regulation that drug company sales forces can actually leave clinical study material with physicians for new indications even before those indications have official approval. This could lead to growing off-label use for the SOTR indication for Levualn/PDT over the next few years, IF ongoing trials continue to be positive.
And, IF DUSA's salesforce and management know how to handle the new regulations.
