I think seizure is a foregone conclusion. The only thing to prevent it from happening too fast: I don't think this saw the hit list til September. I think most banks that are being seized have the FDIC working a few months with them to reduce their balance sheet, and then when they have a good picture, they present this to other banks for purchase. Here, I don't think any acquiring bank would feel that they have a good enough picture to bid, or even consent to getting it taken over, as I think the true picture is still murkey.
This is not to say that it will not be taken over, I think it will. The only delay I believe is that this information is still going through the ranks of the feds, as I don't think they have an idea on how bad it is yet.
