I have seen this before. It trades a little lower than the merger value because of uncertainties in the process; the merger may not occur, the lawsuit may go bad, or the price of ELOS may drop. I understand there is at least one mutual fund that exclusively hedges these kinds of mergers, so the phenom is common.
