No, I don't believe that.
Please show me the exact law paragraph, which says
that fair valued equity can
'be stolen' by creditors.
If that 5US $ Billion was correct, then the shareholders should have got something.

So I think, the Assets were revalueated to exactly cancel the equity.

Then I ask, why did they post 5 Billion in equity in the report knowing that in another 2 weeks the assets are devaluated ?

Back to Infomemo Search
DATE: DECEMBER 10, 2009
SUBJECT: CIT GROUP INC. – CONTRACT ADJUSTMENT/SYMBOL CHANGE
OPTION SYMBOLS: CIT/VVF (11)
NEW SYMBOL: CIT CHANGES TO EHJ ON 12/11/09
DATE: 12-10-09
***UPDATE***
On December 10, 2009, CIT Group Inc. Joint Plan of Reorganization became effective under Chapter 11 of the Bankruptcy Code. Pursuant to the Plan of Reorganization, all outstanding CIT Group Inc. (“CIT”) Common Shares have been cancelled.
THE FOREGOING IS AN UNOFFICIAL SUMMARY OF THE PERTINENT TERMS OF THE PLAN OF REORGANIZATION AND PREPARED BY OCC FOR THE CONVENIENCE OF CLEARING MEMBERS. OCC ACCEPTS NO RESPONSIBILITY FOR THE ACCURACY OR COMPLETENESS OF THE SUMMARY. CLEARING MEMBERS SHOULD REFER TO THE PLAN OF REORGANIZATION FOR ADDITIONAL INFORMATION.
CONTRACT ADJUSTMENT
Pursuant to Article VI, Section 11, of OCC's By-Laws, a panel of OCC's Securities Committee has determined to adjust all CIT options as indicated below (the panel consists of two representatives from the Exchanges on which the affected option is traded (in this case the Chicago Board Options Exchange (“CBOE”), the International Securities Exchange (“ISE”), NYSE AMEX Exchange (“AMEX”) and the NASDAQ OMX Exchange (“NASDAQ” )), and the Chairman of OCC or his delegee, who only votes in case of a tie).
Effective December 10, 2009, existing CIT options are adjusted to no longer call for the delivery of CIT Group Inc. Common Shares upon exercise.
Effective December 11, 2009 the option symbol CIT will change to EHJ. The option symbol VVF (11) will not change.
In settlement of CIT Group Inc. (Old) exercise/assignment activity, a put exerciser (or call assignee) will receive a cash payment of the full aggregate strike price amount on the exercise settlement date. A put assignee (or call exerciser) will pay this amount on the exercise settlement date. Settlement will take place through OCC’s cash settlement system on the third business day after exercise.
Since CIT Group Inc. (Old) options are American-style, they are exercisable at the election of the holder. Expiration processing for EHJ/VVF options will take place in the normal fashion, including automatic exercise thresholds.
Clearing Member input to OCC must use the new option symbol EHJ commencing December 11, 2009. Strike prices and all other option terms will not change.
CATEGORY: CONTRACT ADJUSTMENT
For questions regarding this memo, call 1-888-OPTIONS or email options@theocc.com.
