My comment:

The a/v transceiver in claim 1 is capable of transmitting time compressed audio/video. Claim 5 adds to the transmission capability of the apparatus in claim 1: that of output via modem & phone line. The a/v transfer network in claims 30 is made up collectively of the transceivers claimed in 1 and 5, and adds the claim of transmission in burst time periods. Claim 32 enlarges on this claim of “bursting” to specifically add that the transceivers claimed include modems and the network includes phone lines. Thus, “burst”capable transceivers with a structure of a modem for telephone communications are clearly covered by the chain of claims from 32 back to 1.

“78. An audio/video transceiver apparatus as in claim 77 wherein said audio/video transmitter/receiver means comprises a modem for coupling to a TELEPHONE TRANSMISSION LINE….

77. An audio/video transceiver apparatus as in claim 73 wherein said output means comprises audio/video transmitter/receiver means….

An audio/video transceiver apparatus comprising:…. output means for receiving said time compressed representation of said digital or corresponding digital audio/video source information stored in said random access storage means for transmission away from said audio/video transceiver apparatus.

My comment:

The a/v transceiver in claim 60 has an output means capable of transmitting time compressed audio/video. Claim 73 adds a high speed bus. Claim 78 adds that the “output” means in 60 and 73 includes a audio/video transmit and receive (“transceiver”) capability. Claim 78 specifies that the transmit/receive functionality in 77 includes a modem to coupled to a telephone line. Thius, the chain of claims from back to 60 clearly cover transmission via a modem structure of time-compressed audio video. And if it is transmitted time-compressed, it is bursted.

And just to put a final nail in the coffin, from 995’s Preferred Embodiment description:

“….. VCR-ET 10 includes audio/video transmitter/receiver 22 which is typically a modem. Advantageously, the modem may be used to communicate an audio/video program over CONVENTIONAL PHONE LINES in a manner similar to that described above with respect to optical fibers….”

Both in the Claims and the Embodiment description, it seems clear to me that a modem connected to phone lines are correctly claimed and described as a structure capable of “for transmitting time compressed signals in a burst period”.. In this Embodiment description Burst even goes to the length of saying “in a manner similar to optical fibers…” On its face, that indicates that means OTHER than fiber optic port are claimed for Bursting.

At least to my myopic, astigmatic view, Apple flunks this fact check test.

This is IMO astoundingly bald intellectual dishonesty being put forth in this Claims Construction Brief.
