With a cerebrellum about the size of (and hardy as tasty as) a tenderloin, I am trying my best to slog through Apple’s Claim Construction Brief.

Given the limited mental facilities hereabouts, I have found a useful technique with such ponderous documents loaded with literally thousands of assertions of “fact”, is to pick a few at random and test them. The result is interesting. Here is one set of “facts” as set forth by the aforementioned Brief:

“…There is only one structure disclosed in the ‘995 patent for receiving and transmitting time compressed information: fiber optic port 18. The ‘995 patent describes the fiber optic port 18 as being capable of receiving source information. The ‘995 patent further discloses that the fiber optic port is used to transmit data at an accelerated rate. The fiber optic port is thus clearly linked to the function of receiving and transmitting time compressed signals. There are no other structures disclosed in the ‘995 patent for transmitting time compressed signals in a burst period.”

I chose to test the last assertion.

“There are no other structures disclosed in the ‘995 patent for transmitting time compressed signals in a burst period”. Nothing other than the “fiber optic port”

Oh really? It appears that the ‘995 patent that Apple is citing (and infringing upon) also makes a unequivocal claim of “burst period” transmission capability via one additional, key and very important other structure:

30. An audio/video information transfer network comprising:..a plurality of audio/video transceivers, coupled via one or more communication links, each of said audio/video transceivers comprising:
… output means, coupled to said random access storage means and to one of said one or more communications links, for receiving the time compressed format representation of said audio/video source information stored in said random access storage means for TRANSMISSION IN SAID BURST TIME PERIOD to another one of said plurality of audio/video transceivers….

5. An audio/video transceiver apparatus as in claim 1 wherein said output means comprises a MODEM for coupling said audio/video transceiver apparatus to a TELEPHONE TRANSMISSION LINE….
