paycheck The answer is yes. Now if you can figure out what question you asked, you have the answer.Apollo can't sell off or dispose of specified properties in any way without letting newmont get them for the same terms someone else has offfered.

But Apollo is free to merge with another company and does not have to offer Newmont the ability to merge on the same terms. All of Apollo's assets would become part of the new corporation.
