How is it unfair to the pensioners? Let's say you retired from CF ten years ago. The fund paying your pension is solvent. Now, ABF is going to abandon the plan? And what becomes of all the pensioners from the dozens of different comapnies? This doesn't make any sense. I see the light on the problem for ABF and YRC. The formula for what they are to contribute is negatively affected every time a member of the pool goes under. But how would the PBGC or Congress establish who should retain their pensions? Just the retirees from the remaining companies? So, a lifetime of contributions went poof in less than a decade. What if I worked for YRC, and now they are not paying in. Am I also an orphan? And what to do with the orphans? LOL ! Good luck solving this one with a bill in Congress!
