_ Due to statutory operating losses recorded by Ambac Assurance in 2008, AAC is not able to declare and pay dividends to the holding company in 2009 without first receiving approval from OCI. Dividends from the operating company to the holding company in 2010 will depend on Ambac Assurance's ability to generate statutory income in 2009 which appears unlikely at this point._
