The other question that needs to be asked is how they do it? The loophole that needs closing is the expediency loophole.

There is a very real predatory form of naked shorting that when combined with vicious rumors and "long term" naked shorting is, IMO criminal, at least highly unethical. By long term, I mean remaining "naked" more than a day.

On this board, there have been many attacks by what I believe were predatory traders. They came close to destroying this company and probably would have, were it not subsidized and supported by the DOD and DOE.

Was the company weak at the time? yes.
Did it deserve to be picked to pieces by predators using con man money scams and viscious rumors. No that would be like sactioning anarchy. It's equivalent to saying it's OK to take as much as you want from a store and don't pay for it, just wear a big coat so you don't get caught.

jthinkhouse may be very misguided about politics, but he is right about this, IMO. His moral compass is working fine.
