I lost 30% from Aug 07 to April 08 when I sold. Other poster(s) are correct, Schwab "Customer Advocacy Team" is not working for you, they are working against you. They record conversations and if you state that you made your own investment decisions (w/o an advisor) they will not offer you any settlement, even pennies on the dollar. Do not disclose anything to them. From a bit of research I outlined the following approaches to attacking Schwab:

1) Try to get Schwab to refund your money - we need to inundate them with calls, emails, complaints, letters, etc.
2) If you lost a larger amount, you can get an attorney that specializes in investment cases to arbitrate or sue for you. "FINRA" (formerly NASD?) is the arbitration forum that we are required to use according to our brokerage agreements with Schwab. See their website. If you didn't lose $10,000 or more, most attorneys won't take your case because they can't make enough. (I lost $5600, which was part of my first-time house down payment).
3) Initiate your own arbitration via FINRA (again, see their website which details all). Fee = $250.
4) Find a pro-bono entity that will arbitrate on your behalf. One example would be law schools, which have programs for this which amounts to work experience for their students, who will be arbitrating for you (for free) under professorial supervision. Remember, each arbitration that Schwab must deal with COSTS THEM MONEY.
5) Join a class action: you won't see much of a return, but at least you will help nail Schwab.

Please add to this list and suggest any corrections or improvements.

FYI, unrelated to SWYPX, Schwab telephone service reps have twice (over several year period)tried to impose unlawful trading fees on my account when I sold mutual fund shares in the past. They told me I had short-term trading fees, which was incorrect. They were trying to say that my reinvested dividends counted as short-term trades !!! I do not believe that they were lacking knowledge or training. I do believe that their ethics are poor.
